SALC is concerned by the targeting and killing of Judge Raphael Yanyi Ovungu, a member of the judiciary in the DRC. We are further concerned that the police initially wrongfully reported that the death was caused by a heart attack when in fact the judge had been murdered. In late May Judge Yanyi was killed while overseeing a corruption trial involving the Congolese President President Félix Tshisekedi’s former chief of staff, Vital Kamerhe. Judge Yanyi was initially reported to have died of a heart attack. However, an autopsy has now shown him to have died as a result of, “blows of sharp points or knife-like objects, which were thrust into his head” according to Justice Minister Celestin Tunda Ya Kasende. The Justice Minister has also stated that a murder investigation has been opened.
In October 2019, in his report on the independence of judges and lawyers, Special Rapporteur on the Independence of Magistrates and Lawyers, Diego Garcia- Sayan, highlighted the importance of the role of state members not only to respect the independence of judges and prosecutors during their decision-making process, but also in establishing systems to ensure their safety and protection.
Article 2-5 of the Universal Charter of the Judge developed by the International Association of Judges, stipulates the following:
“judges must benefit from a statutory protection against threats and attacks of any kind, which may be directed against him/her, while performing his/her functions. Physical security for the judge and his/her family must be provided by the State. Protective measures for the courts must be put in operation by the State.”
We recall Article 11 of the UN Basic Principles on the Independence of the Judiciary which states that “the term of office of judges, their independence, security . . .shall be adequately secured by law.”
SALC Executive Director, Kaajal Ramjathan-Keogh states that: “We call upon the Government of DRC to investigate and prosecute the perpetrators of this heinous crime and to ensure the protection of members of the Judiciary as well as the legal fraternity and to put measures in place to ensure their safety. We continue to closely monitor the developments in this matter”.

Déclaration Condamnant le Meurtre du Juge Raphael Yanyi Ovungu
SALC est préoccupé par la prise pour cible et le meurtre du juge Raphael Yanyi Ovungu, membre du pouvoir judiciaire en RDC. Nous sommes également préoccupés par le fait que la police ait initialement indiqué, à tort, que le décès était dû à une crise cardiaque alors qu’en fait le juge avait été assassiné. Fin mai, le juge Yanyi a été tué alors qu’il présidait un procès pour corruption impliquant l’ancien chef de cabinet du président congolais Félix Tshisekedi, Vital Kamerhe. Le juge Yanyi serait initialement décédé d’une crise cardiaque. Cependant, une autopsie a montré qu’il était décédé des suites de “coups d’objets acérés ou en forme de couteau, qui lui ont été enfoncés dans la tête”, selon le ministre de la Justice Celestin Tunda Ya Kasende. Le ministre de la Justice a également déclaré qu’une enquête pour meurtre avait été ouverte.
En octobre 2019, dans son rapport sur l’indépendance des juges et des avocats, le rapporteur spécial sur l’indépendance des magistrats et des avocats, Diego Garcia-Sayan, a souligné l’importance du rôle des États membres non seulement pour respecter l’indépendance des juges et des procureurs pendant leur processus décisionnel, mais aussi dans la mise en place de systèmes garantissant leur sécurité et leur protection.
L’article 2-5 de la Charte universelle du juge élaborée par l’Association internationale des juges, stipule ce qui suit:
«Les juges doivent bénéficier d’une protection statutaire contre les menaces et attaques de toute nature, qui peuvent être dirigées contre eux/elles, dans l’exercice de leurs fonctions. La sécurité physique du juge et de sa famille doit être assurée par l’État. Les mesures de protection des tribunaux doivent être mises en œuvre par l’État. »
Nous rappelons l’article 11 des Principes fondamentaux des Nations Unies sur l’indépendance du pouvoir judiciaire qui stipule que « La durée du mandat des juges, leur indépendance, leur sécurité … sont garantis par la loi. »
La Directrice exécutive de SALC, Kaajal Ramjathan-Keogh, déclare : «Nous demandons au gouvernement de la RDC d’enquêter et de poursuivre les auteurs de ce crime odieux et d’assurer la protection des membres du pouvoir judiciaire ainsi que la fraternité juridique et de prendre des mesures afin d’assurer leur sécurité. Nous continuons de suivre de près l’évolution de la situation ».
