This case concerns the rights of detainees and the significance of health considerations in determining bail in Malawi. It followed the arrest of a 15 year old boy, Mr Mphembedzu, on suspicion of homicide in 2007.  Mr Mphembedzu was then remanded at Bvumbwe prison whilst awaiting trial. He was seriously ill after having contracted a chronic illness during his imprisonment. SALC assisted in his bail application arguing that the health of awaiting trial prisoners must be taken into consideration in bail proceedings and secured his release.
