Stanfield v Minister of Correctional Services and others (High Court 2003)
2nd January 2003, 12:00 pm
Stanfield was serving a six year prison sentence when he was diagnosed with an incurable and inoperable lung cancer. Stanfield applied for parole on medical grounds, which was denied. He appealed the denial to the High Court.
The High Court held that the refusal to grant Stanfield parole violated his right to human dignity. In reaching its finding, the Court noted the fact that the decision to deny parole did not take into full account the nature of Stanfield’s medical condition and the inadequacy of medical facilities at the prison for treating Stanfield’s illness.
