PAIA applicable to corporations operating outside of SA

The key question raised by a new set of requests for information filed by SALC with the New Reclamation Group is whether the constitutional right given effect to through the enactment of Promotion of Access to Information Act (PAIA) are only available for the benefit of persons within South Africa. SALC petitioned South African company, Reclam, for access to information that will shed some light on its controversial mining operations in Marange Diamond fields of Zimbabwe to show whether any of its promises to the local community have been fulfilled. The petition was in terms of South Africa’s PAIA. It was done on behalf of South African Resource Watch and 3 Zimbabweans. SALC has filed a new set of requests pertaining to this. The 3 Zimbabwe community members seek access to information from Reclam for the protection and enforcement of their rights within Zimbabwe.
